Cosmolytic

Terms and conditions

This is an English translation for information. The contract language is German, and the German AGB are the legally binding version.

§ 1 Scope

(1) These terms apply to all contracts for digital products (e.g. downloadable calendars and personal PDF reports) concluded via sterne.cosmolytic.com, stars.cosmolytic.com, sterren.cosmolytic.com or the product pages linked there between Anonyfox e. K., owner Maximilian Stroh, Zehntland 2d, 21079 Hamburg, Germany ("Provider") and the customer.

(2) Customers may be consumers (§ 13 BGB) or businesses (§ 14 BGB). Deviating terms of the customer do not apply unless the Provider expressly agrees in writing.

§ 2 Conclusion of contract and contract language

(1) The presentation of products is not a binding offer. (2) By completing the order via Stripe Checkout ("Pay" or similar) the customer makes a binding offer. The contract is concluded when the Provider confirms the order by email or delivers the product. (3) The contract language is German. The English and Dutch versions of these terms, the withdrawal policy and the privacy policy are provided for information; the German version prevails. Mandatory consumer protection rules remain unaffected. (4) The contract text is not stored separately; the customer receives the order data and these terms by email.

§ 3 Prices and payment

(1) All prices are final prices in euros. Under § 19 UStG (German small business scheme), no VAT is charged.

(2) This also applies to consumers resident in another EU member state: the prices shown are final prices and no VAT is shown.

(3) Payment is made in advance via Stripe using the payment methods offered there. An invoice without VAT, referring to § 19 UStG, is sent electronically.

§ 4 Performance and delivery

(1) Digital content is provided after payment via download link or email. Personal digital content (e.g. astrology reports based on the birth data provided) is delivered by email within the period stated in the product description. (2) The customer is responsible for the accuracy of the birth data provided. (3) The customer receives a simple, non-transferable, perpetual right of use for personal purposes. Resale and public distribution are not permitted; sharing the included story and badge images on social media is expressly allowed.

§ 5 Right of withdrawal and early expiry

(1) Consumers have a right of withdrawal as set out in the withdrawal policy. Businesses have no right of withdrawal.

(2) Digital content not supplied on a tangible medium: the consumer's right of withdrawal expires under § 356 (6) BGB once the Provider has begun performance after the consumer has (a) expressly agreed that the Provider begins performance before the withdrawal period ends, and (b) acknowledged that this consent means losing the right of withdrawal once performance begins, and the Provider has (c) provided the contract confirmation under § 312f BGB. The customer gives consent and acknowledgement at Stripe checkout; the contract confirmation follows by email.

(3) Digital content made to the customer's specifications (e.g. horoscope reports based on the customer's data): there is no right of withdrawal under § 312g (2) no. 1 BGB; alternatively paragraph 2 applies.

§ 6 Warranty

(1) For consumers the statutory provisions apply, in particular §§ 327 et seq. BGB for digital products, including the update obligation under § 327f BGB. (2) For businesses the limitation period for claims for defects is one year from delivery; this does not apply to claims under § 7.

§ 7 Liability

(1) The Provider is liable without limitation for intent, gross negligence, injury to life, body or health and under the Product Liability Act. (2) For slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract. Otherwise liability for slight negligence is excluded. (3) Astrology reports and calendars are interpretive guidance for self-reflection and entertainment. They contain no guarantee of events and do not replace medical, psychological, legal or financial advice.

§ 8 Final provisions

(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the country of their habitual residence. (2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction is Hamburg. (3) The EU Online Dispute Resolution platform was discontinued on 20 July 2025. The Provider is neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. (4) If individual provisions are invalid, the remainder of the contract remains valid. (5) Information on the processing of personal data is in the privacy policy.
